ShoreTel Lobs A Lawyer Back At Mitel Print E-mail

ShoreTel has filed counterclaims against Mitel in response to the latter's patent infringement lawsuit against ShoreTel. The tit for tat lawsuit rally began a little over a month ago when Mitel decided ShareTel was violating some of its patent portfolio.

Mitel's timing was particularly nasty as it was on the eve of ShoreTel's initial public offering and it forced ShoreTel to temper its ask on the NASDAQ to the tune of about a dollar a share according to estimates made at the time.

ShoreTel no doubt sees the whole ploy as a bit of a spoiler for its IPO and is consequently also filing claims for approximately US$10 million in damages and an injunction against Mitel in Ontario Superior Court for making false or misleading statements about ShoreTel's alleged infringement.

The whole circus takes place in the shadow of Vonage versus Verizon Patent Infringement court action and the two disputes are probably just the start of many that will surface as money starts to flow from the technology.

Anyway, in addition to denying all of Mitel's claims of patent infringement , ShoreTel alleges that Mitel's IP phone systems, including the Mitel 3300 IP Communications Platform, infringes ShoreTel's U.S. Patent No. 7,167,486 B2 entitled "Voice Traffic Through a Firewall."

"We are confident in our position, and believe the timing of Mitel's filing was intended to interfere with our later successful IPO," said John W. Combs, Chief Executive Officer of ShoreTel. "ShoreTel will defend its position and pursue its claims against Mitel vigorously."
